Mediation &
Arbitration
Mediation and arbitration are alternative dispute resolution processes that are private and cost-effective mechanisms used to to achieve a settlement. Rosen Sack offers both methods for family law; and mediation for estate & capacity litigation disputes.
Mediation is a less adversarial and timely way for parties to voluntarily resolve a dispute. Practical solutions can be crafted in this private negotiation, saving the time, tension and expense of going to court.
In arbitration, the parties involved agree to have an impartial third party, rather than a judge, hear evidence before making an arbitral award. This is similar to a trial, but far more private.
